Banking and finance litigation is one of the most demanding areas of commercial practice in Bangladesh. It combines strict statutory procedure under the Artha Rin Adalat Ain 2003 with the commercial realities of mortgage enforcement, NPL recovery, and Bangladesh Bank regulation. Sovereign Chambers of Law has acted in this field for over a decade on behalf of commercial lenders, NBFIs, and individual borrowers.

What we handle

  • Artha Rin recovery suits. Contested and consent suits in the Artha Rin Adalat; execution and mortgage-sale proceedings under s.33; defences, set-offs, and counter-claims for borrowers.
  • Money suits and commercial recovery. Civil money suits before the Senior Assistant Judge and the Joint District Judge; Order XXXVII summary-procedure suits.
  • Writ jurisdiction. Writ petitions in the High Court Division challenging Bangladesh Bank directives, CIB reporting, regulatory enforcement, and procedural unfairness in bank-led disciplinary action.
  • Cheque dishonour (NI Act). Criminal proceedings under s.138 of the Negotiable Instruments Act 1881; appeals under s.138A; criminal revisions.
  • Labour matters for banks. Representation before the Labour Court and Labour Appellate Tribunal in employment disputes involving bank staff.
  • Guarantees and security documents. Advice on enforceability of personal guarantees, charge documents, hypothecation, and pari passu arrangements.

Our approach

We advise from both sides of the lending relationship. For banks, we focus on speed of recovery, correctness of procedural steps that survive later scrutiny, and protection against reputational or regulatory fall-out. For borrowers and guarantors, we focus on identifying procedural defects, challenging over-reach, and negotiating settlements that preserve business continuity.
